Updated I-9 form in the works


The National Restaurant Association this week weighed in on a proposed update of the I-9 form, the form that all employers and employees must fill out to certify an employee's identity and eligibility to work in the United States.

The Department of Homeland Security has proposed changes aimed at making the I-9 clearer and more user-friendly for employers and employees. The NRA commended the goal but noted that some of the DHS's suggested changes could add confusion -- and, if left unchanged, could put employers in jeopardy of immigration-related paperwork fines for inadvertent violations.

"The new I-9 form is in some ways more user-friendly, but there are portions of the form that raise concerns for employers in our industry," the NRA said in comments submitted to the DHS May 29. "Employers want to comply with the law; however, [Immigration and Customs Enforcement] should provide guidance on how violations will be determined if one of these mistakes takes place in good faith."
